SR -Endorsement of Plans1 Town of Barnstable Planning and Development Department Staff Report Date: June 9, 2023 To: Steven Robichaud, Chair, Planning Board From: Department of Planning & Development Staff Re: Endorsement of Plans – Old Stage Road and Parker Lane and Mother’s Park The Planning Board has three requested endorsements of plans to consider. Each plan endorsement has a different set of standards to complete prior to endorsement by the Board. Subdivision No. 827 – Definitive Plan entitled: Plan of Land on Old Stage Road and Parker Lane Background The Planning Board recently approved a definitive subdivision entitled, “Definitive Subdivision Plan of Land on Old Stage Road and Parker Lane in Barnstable, MA”, last revised February 25, 2023, by Gallagher Engineering. No appeals were made and the decision is final. Procedure The Applicant has now completed Conditions 2 and 3 of the Definitive Subdivision decision: 2. Prior to the endorsement of the subdivision plan, the Applicant shall complete and endorse; a. A Development Agreement with the Planning Board for completion of the Subdivision. Such agreement shall be reviewed and approved by the Town Attorney prior to endorsement by the Planning Board. b. A Form F, Covenant, placing the undeveloped lots as surety for completion of the Subdivision. c. A Form S, Road Maintenance and Repairs, requiring the applicant and successors in title to be responsible for all maintenance, including snow removal, and repair of the new private way. d. The Declaration of Trust creating a Homeowners Association for the two lots and entrusting it with the continued maintenance of the common areas, easements and enforce the covenants imposed. 3. The Applicant shall submit a check in the amount of $1,000.00 dollars, payable to the Town of Barnstable. The check shall be held to ensure the recordation at the Barnstable County Registry of Deeds a copy of the decision notice when final approval by the Town Clerk, the endorsed definitive subdivision plan, the signed Development Agreement, the Covenant, and executed Form S, and the Declaration of Protective Covenants for a Homeowners Association. Once the Board endorses the Definitive Subdivision plan the Applicant shall record the documents in Condition 2 along with the Definitive Subdivision Plan. This then allows for the Applicant to begin work on 2 the infrastructure. Once the infrastructure is substantially complete the Applicant will then return to release the lots from covenant and request a building permit. At this time it is recommend to endorse the Definitive Subdivision plan. Motion: To (endorse or not to endorse) the plan entitled “Definitive Subdivision Plan of Land on Old Stage Road and Parker Lane in Barnstable, MA” prepared for William Eagan, by Gallagher Engineering, last revised February 25, 2023. Mother’s Park Road, Centerville – Endorsement of Roadway Discontinuance and Taking Plans Background A discontinuance of land and Taking Plan have been submitted in accordance with M.G.L. Ch. 41 §81L entitled “Roadway Discontinuance Plan, Mother’s Park Road, Village of Centerville, Barnstable, Massachusetts” prepared for Town of Barnstable, by Town of Barnstable and “Roadway Taking Plan Mother’s Park Road” prepared for Town of Barnstable, by Town of Barnstable. The plan of land proposes to discontinue Mother’s Park Road and the taking of abutting land as described on the plans for the following reasons: The Town is proceeding with plans to install sewers and related infrastructure in Centerville. These proposed takings of the fee in Mother’s Park Road will enable the Town to install an underground sewer pump station in the former roadway as a vital component of the Town’s approved Comprehensive Wastewater Management Plan. The Town also contemplates making alterations to Mother’s Park to correct severe turning and sightline deficiencies at the intersection of Craigville Beach Road. Article 97 of the Amendments to the State Constitution requires the Town to substitute land to replace that removed from the current configuration of Mother’s Park. The taking of this land will allow the Town to add significant square footage to Mother’s Park in excess of that actually removed for the safety improvements. Procedure Town Council referred action to abandon Mother’s Park Road to the Planning Board for consideration and to take abutting land as described on the plans. The Planning Board, on February 27, 2023, recommended to Town Council abandonment of Mother’s Park Road as identified on “Roadway Discontinuance Plan, Mother’s Park Road, Village of Centerville, Barnstable, Massachusetts”, by Town of Barnstable and “Roadway Taking Plan Mother’s Park Road” prepared for Town of Barnstable, by Town of Barnstable. Town Council then affirmed the recommendation and approved the discontinuance of Mother’s Park. The next step is for the Board to endorse the plan entitled “Roadway Discontinuance Plan Mother’s Park Road” prepared for Town of Barnstable, by Town of Barnstable, dated April 15, 2023 and “Roadway Taking Plan Mother’s Park Road” prepared for Town of Barnstable, by Town of Barnstable, dated April 15, 2023.
