Waiver request 2-17-23rJa!!aqheJz tnqineeJzinq CIVIL ENGINEERING·STRUCTURAL ENGINEERING·LAND SURVEYING 4 WINDSOR DRIVE FOXBORO,MA 02035 508-543-9894 February 17,2023 James Kupfer,Senior Planner Barnstable Planning Board 367 Main Street Hyannis,MA.02601 Re:Definitive Subdivision Plan,Parker Lane Dear James, On behalf of the applicant,William Eagan,we are requesting the following waivers from Chapter 801.Subdivision Regulations.Understanding that the proposed roadway falls within the definition of a Minor B roadway as shown in Appendix A of the regulations,the following waivers are requested: 801-24.A.1.(a)[16]Environmental Analysis Report:For a two lot subdivision we do not believe that an Environmental Analysis report is necessary.We have added notes to the plan saying that there are no wetlands on the property,that it is not in a Priority Habitat Area,and that it is not in an A.C.E.C. 801-24.C.Profile Sheet.The proposed roadway will be placed at the same grade as the existing Parker Lane.It will be widened and excavated to subgrade than brought back up to existing grade with a 15 inch gravel base as a final roadway surface. 801-24.E.(6-9)Review by Other Officials.These sections require that final approval of the definitive plans will be held up pending approval of utilities by the electric,gas, telephone,and cablevision companies.Utility companies will not give approval until an approved definitive plan is provided to them. 801-24.J.(5)Binder Course.This section specifies that an occupancy permit for a house cannot be granted until at least the binder course of pavement is installed.In this case the completed roadway is to remain gravel. 801-24.N.(3)(a.)Hydrant System.This section requires that the Fire Chief grant approval of the installation of the hydrant system.There are no hydrants being proposed as there is no public water system available at the site. 801-27.C.(4)Drainage.This section requires side slopes of 4 to 1 for BMP's.We are requesting side slopes of 3 to 1. 801-27.C.(5)Drainage.This section requires that catch basins be spaced 300 feet apart. 801-29 Sidewalks.No sidewalks exist in the vicinity of Parker Lane and Service Road and none are proposed for this roadway. 801-30 Curbing and Berms.No curbing is proposed.The "country"drainage system allows roadway run off to sheet flow into the drainage swales. 801-45 Roadway Surface.We are requesting a waiver to allow a 15 inch thick gravel roadway with no pavement. 801-46 Sidewalks.No sidewalks exist in the vicinity of Parker Lane and Service Road and none are proposed for this roadway. 801-47 Curbing and Berms.No curbing is proposed.The "country"drainage system allows roadway run off to sheet flow into the drainage swale. 801-49 Street Trees.No street trees are being proposed.Both sides of Parker Lane are heavily wooded and most of the existing vegetation will be preserved. 801-52 Monuments:This section requires that monuments be placed at all points of change in direction.We are proposing to place 9 monuments,6 bounds and 3 iron rods. This,combined with the existing perimeter monuments shown on the plan will provide more than enough survey control to re-trace the property lines. Appendix A Minor Road B Cross section.The following waivers are requested: Right of Way width 40 feet.The existing Right of Way is 33 feet wide. Roadway Surface.We are requesting a waiver to allow a 15 inch thick gravel roadway with no pavement. In accordance with Section 801-5 Waivers,we believe that our request for these waivers will maintain the rural character of the area and are not inconsistent with the Subdivision Rules and Regulations.
