Tom Lee Re: Notice of Intent: Construction of a Shared-Use Path Along Bearse’s Way, From Route 28 to Pitchers Way (MassDOT Project # 609067) Barnstable, Massachusetts Dear Chairman Lee and Commission Members: On behalf of the Town of Barnstable Department of Public Works, (the Applicant) VHB, Inc. is submitting the attached Notice of Intent (NOI) for the proposed construction of a shared use path along a portion of Bearse’s Way (the Project) between Route 28 and Pitcher’s Way in Barnstable, Massachusetts. This NOI is being filed under the Town of Barnstable Wetlands Protection Ordinance (the Ordinance) and its implementing regulations (Chapters 237 and 704). No portion of the Project is proposed within areas subject to the jurisdiction of the Massachusetts Wetlands Protection Act (MGL Chapter 131, Section 40) and its implementing regulations (310 CMR 10.00). Proposed work consists of constructing a new 10-foot-wide shared use path with 3-foot shoulders, drainage improvements, lighting upgrades and landscaping consisting of native tree and shrub plantings. The full scope of work is described in the attached NOI Narrative. Work will be required in the 50-foot buffer zone from the edge of Vegetated Wetland established by the Ordinance. Work within the 50-foot buffer zone will be required as detailed in the NOI Narrative, therefore the project requests a waiver from the bylaw for this segment of work. The Project has been designed to minimize impacts to wetland resources. Areas of temporary disturbance will be revegetated as part of the Project’s landscaping plan. Because work within the 50-foot buffer zone is unavoidable, the Applicant is requesting that the Commission grant the Project a waiver of the Performance Standards found in Section 704-3 of the Ordinance. Because the Project consists of constructing an access path, it is exempt from the mitigation plantings requirements established by the Ordinance. During construction, erosion controls will be installed to protect adjacent resources. In compliance with the Ordinance, notification to abutters regarding this NOI will be made by certified return receipt mail upon receival of a meeting date. A copy of the certified list of abutters are enclosed as part of the NOI. As a municipally sponsored Project, the Town is not subject to filing fees. March 2022 Page 1 CHAPTER 707 Regulation Governing Minimum Submission Requirements for a Notice of Intent Application The Barnstable Conservation Commission has adopted the following requirements in order to obtain more consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent (NOI) applications. Failure to complete any of the items in this checklist may result in your application being denied. Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain instances, like field staking, denoting that the task will be completed. The following submission checklist covers the requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of Barnstable. The cost of the legal ad will be pre-calculated and posted on the hearing agenda prior to the hearing. 5.Minimum Documentation for a Complete Application: a.Provide a completely filled-out (in all parts) NOI application as locally adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form. Indicate Assessor’s map and parcel of the project, as well as the street or road address, and pertinent village (i.e., Hyannis, Centerville, Barnstable, etc). b.Provide two (2) original project plans, stamped in blue or red ink (wet stamp). Plans must be signed and dated by a Massachusetts licensed, professional engineer, land surveyor, architect or landscape architect (as applicable), and shall be drawn at a readable scale (1" = 20' preferred). The planting plan shall include species list (chosen from the Town of Barnstable Conservation Commission approved planting lists), sizes, densities and/or quantities. The plan shall also provide area calculations between 0 to 50 and 50 to 100 separately for the amount of mitigation planting required, and the amount of mitigation planting proposed. e.Provide detailed, written street directions to the locus (site). f.Provide a copy of a U.S.G.S. locus map indicating the general area of the project site. g.Provide a check for the Town of Barnstable portion of the required filing fee. (The portion payable to the Commonwealth, see 7. e. below) h.Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in the field which may be relevant to the application. 6.The site plan shall also show: a.All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred). b.Clear delineation of all existing and proposed structures and features. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource a reas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On complicated sites, existing and proposed conditions must be shown on separate sheets. c.Locus inset map of the site clearly showing its location relative to surrounding public streets. d.All wetland resource area flags by individual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area. The individual who performed the flagging and date of flagging shall be identified on the plan next to the resource line. e. Introduction The Town of Barnstable Department of Public Works (the Applicant) is proposing to construct a shared-use path on the west side of Bearses Way, beginning 450 feet north of Falmouth Road (Route 28) and ending at Pitcher’s Way in Barnstable, MA. Work is proposed as part of the Massachusetts Department of Transportation (MassDOT) Transportation Improvement Program (TIP) for Fiscal Year 2023 (MassDOT Project #609067). The Project consists of constructing a new 0.72-mile paved bicycle and pedestrian shared-use path along a grassed and wooded area on the west side of Bearses Way. The proposed path will be separated from the road to improve pedestrian safety and comfort. The paved width of the path will be 10 feet wide, with three-foot unpaved stabilized shoulders on each side. Utilities will be relocated as necessary, and drainage will also be improved as appropriate. Pedestrian scale lighting will be installed for the length of the Project Limits. Landscaping consisting of native tree and shrub plantings is also proposed along the Project limits. The proposed work will occur in the vicinity of Vegetated Wetlands considered jurisdictional areas as defined by the Ordinance. The Project will occur primarily in degraded buffer zone associated with the Bearses Way roadway layout and will not result in any permanent or temporary impacts to wetland resource areas. Work is also proposed within the 50-foot buffer zone established by the Ordinance and therefore the Applicant is requesting a waiver of the Performance Standards for Projects Requiring a Notice of Intent (704-3A). Areas near the Project Limits are regulated as Isolated Land Subject to Flooding (ILSF) under the Massachusetts Wetlands Protection Act (WPA)(MGL Chapter 131, Section 40) and its implementing regulations (310 CMR 10.00) However, the Project does not require work within any areas subject to WPA jurisdiction. Wetland resource areas will be protected from impacts during construction through the implementation of an erosion and sedimentation control program. This program includes provisions to minimize areas of disturbance through phasing and sequencing, limit erosion through stabilization, and prevent sediment from leaving the site by installing structural controls. Runoff generated from the project will be collected and treated in accordance with design guidelines 1 developed by Department of Environmental Protection (DEP) and standards contained in the WPA Regulations. 1 DEP, 2008. Notice of Intent A-2 Attachment A: Notice of Intent Narrative Site Description The section of Bearses Way within the Project Limits runs approximately 0.72 miles from 450 feet north of Route 28 to Pitcher’s Way in Barnstable, MA (See Figure 1 Locus Map and Figure 2 Aerial Map). Currently, there are paved shoulders of varying width from about 1- to 5-feet wide along both sides of the roadway, and an existing 5-foot sidewalk along the east side of Bearses Way in this area. However, the existing sidewalk requires additional crossings at busy intersections on the north and south limits of this project, it is directly adjacent to the road, and it is relatively narrow and does not comply with all current Americans with Disabilities Act (ADA) standards. According to the regional Natural Resources Conservation Service (NRCS) soil survey, the most dominant soil type within the Project limits is a mix of, Hinckley loamy sand and Eastchop loamy fine sand with some areas of Urban Land 2. No portion of the Project limits will require work in mapped Priority or Estimated Habitat of Rare Species, or Wildlife as determined by the Massachusetts Natural Heritage and Endangered Species Program (NHESP)3. The Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps (FIRM)4 produced for the Town of Barnstable indicates that no portion of the project limits are located within a 100-year Floodplain regulated as Bordering Land Subject to Flooding (BLSF) under the WPA (Figure 4: FEMA Map). The Project is not located within an Outstanding Resource Water (ORW)5 or Area of Critical Environmental Concern. Most of the Project limits are located within a Zone II Wellhead Protection area 6. Wetland resource areas on/near the site are described below. Wetland Resource Areas Wetlands in the vicinity of the Project Limits were delineated on May 16, 2018, by environmental scientists with VHB in accordance with methods developed by the DEP 7 and the U.S. Army Corps of Engineers.8 The following sections of this narrative describe the wetlands and identify resource areas that are regulated under the WPA Regulations and the Ordinance. The state-regulated wetland resource areas identified in the vicinity of the Project limits are regulated as Isolated Land Subject to Flooding (ILSF) defined under the WPA Regulations 310 CMR 10.57 (1)(b) as an isolated depression or a closed basin which serves as a ponding area for run-off or high ground water which has risen above the ground surface.” The Ordinance also establishes jurisdiction over vegetated wetlands which are defined as “any area of at least 500 square feet where surface or ground water, or ice, at or near the surface of the ground support a plant community dominated (at least 50%) by wetland species. 2 USDA Natural Resources Conservation Service, 2022. Notice of Intent A-4 Attachment A: Notice of Intent Narrative Wetland 1 Wetland 1 is a large basin adjacent to Bearses Way and the DPW facility located at 593 Bearses Way in Hyannis. Site personnel report that the area dries up in most years but contains water for extended periods during times of high groundwater. The basin is bounded by Bearses Way to the east, and DPW facility paved parking and access roads to the north, south, and west. Wetland 1 receives flow from an inlet adjacent to Bearses Way and contains palustrine emergent (PEM) vegetation. Typical wetland species include narrow-leaf cattail (Typha angustifolia) and panic grass (Panicum sp.) with bayberry (Myrica pensylvanica) shrubs, weeping willow (Salix sepulcralis) and black willow (Salix nigra) along the fringe. Typical upland plants include red oak (Quercus rubra) shrubs, common plaintain (Plantago lanceolata), oriental bittersweet (Celastrus orbiculata), pitch pine (Pinus rigida), yarrow (Achillea millefolium), and black cherry (Prunus serotina) shrubs. While no volume calculations were performed, based on visual observations it is assumed that Wetland 1 supports ILSF under the WPA. The WPA does not establish any buffer zones from ILSF. Additionally, because Wetland 1 is greater than 500 square feet in area, it also supports Vegetated Wetland under the Ordinance. The Ordinance establishes a 50-foot buffer zone and a 50 to 100-foot buffer zone which extend from the limits of Wetland 1. Wetland 2 Wetland 2 is a large, isolated basin, southwest of Bearses Way and southeast of Wetland 1 separated from Wetland 1 by an access road. Wetland 2 is bounded to the north by the DPW access road, to the east by Bearses Way, and to the south and west by the DPW facility. The area contains palustrine emergent (PEM) vegetation, as well as some trash and debris. Typical wetland species are dominated by common reed (Phragmites australis), with some broad-leaf cattail (Typha latifolia) in the center of the basin and large black willow, and weeping willow around the edge. Typical upland species include oriental bittersweet, pitch pine, red oak, multiflora rose (Rosa multiflora), Virginia creeper (Parthenocissus quinquefolia) and Tartarian honeysuckle (Lonicera tartarica). While no volume calculations were performed, based on visual observations it is assumed that Wetland 2 supports ILSF under the WPA. The WPA does not establish any buffer zones from ILSF. Additionally, because Wetland 2 is greater than 500 square feet in area, it also supports Vegetated Wetland under the Ordinance. The Ordinance establishes a 50-foot buffer zone and a 50 to 100-foot buffer zone which extend from the limits of Wetland 2. Buffer Zone The WPA regulations do not establish any buffer zones from the limits of ILSF associated with Wetlands 1 and 2 described above, therefore the Project will not require work within areas subject to jurisdiction of the WPA. However, the Commission has established in its Performance Standards for Projects Requiring a Notice of Intent (704-3A) that a 50 ft undisturbed buffer zone shall be retained between the landward- most wetland resource areas and the limit of proposed site disturbance. A 50-foot buffer zone associated with Wetland 1 extends into the Project limits. The 50-foot Buffer Zone consists of portions of the mowed and maintained shoulders of Bearses Way as well as chain link fencing and limited wooded areas. Notice of Intent A-5 Attachment A: Notice of Intent Narrative The Commission also regulates a 50 to 100 ft buffer zone which is defined as the area of land extending 50 ft horizontally outward from the boundary of the 50 ft buffer zone and terminating at the outer edge of the Commission’s 100 ft jurisdictional zone. The 50 to 100-foot buffer zone extends from the boundary of Wetlands 1 and 2 in the Project Limits. The 50 to 100 ft buffer zone consists of mowed and maintained shoulders of the Bearses Way roadway layout, a small area wooded with pitch pine, red oak and gray birch, and driveways and structures associated with the Barnstable Water Pollution Control Division property. Work Description The Project consists of constructing a new 0.72-mile paved bicycle and pedestrian shared-use path along a grassed and wooded area on the west side of Bearses Way. The proposed path will be separated from the road to improve pedestrian safety and comfort. The paved width of the path will be 10 feet wide, with 3-foot unpaved stabilized shoulders on each side. Utilities will be relocated as necessary, and drainage will also be improved by installing a grass swale along the Project alignment. Lighting will be installed through wooded areas, while open areas will be lit by existing streetlights. Native shrubs will be planted along the DPW chain link fence for visual screening and a safety buffer (See Sheet #33 of the Project plans for details on proposed plantings) . A crosswalk and ADA- compliant sidewalk ramps will be installed across Pitcher’s Way at Bearses Way. Work in the 50-foot Buffer Zone and 50 to 100-foot buffer zone is described below. This work fully complies with all applicable performance standards under the WPA as demonstrated in the Regulatory Compliance section of this Narrative. Due to the unavoidable work within the 50-foot Buffer Zone, the Applicant is seeking a waiver of this provision of the Performance Standards per Section 704-4 of the regulations. Work in Locally Established Areas A small portion of work is proposed within the locally established 50-foot buffer zone associated with Wetland 1. Work will support constructing the paved shared use path and shoulders. To facilitate construction, clearing and grubbing, installing tree protection measures, and placing erosion and sedimentation controls along the limits of work are all proposed within the 50-foot buffer zone. Additionally, the Applicant is proposing a comprehensive landscaping plan along the corridor including native tree and shrub plantings within the 50-foot Buffer Zone. As described above, the Project will require unavoidable work within the 50 to 100-foot Buffer Zone associated with Wetland 1 and Wetland 2. Work in the Buffer Zone consists of full depth pavement construction of the 10-foot-wide shared use path with 3-foot shoulders. Associated work includes clearing and grubbing, improving and repaving driveway crossings, loam and seed placement, installing erosion controls near wetland resource areas and installing tree protection during construction activities. Drainage improvements are also proposed along the limits of the path in the Buffer Zone and consist of new drainage ditches with stone for pipe ends. Notice of Intent A-6 Attachment A: Notice of Intent Narrative Mitigation Measures A suite of mitigation measures is proposed to prevent short- and long-term impacts to wetland resource areas. Mitigation measures proposed for this project include both structural and non- structural practices as described below. Erosion and Sediment Control An erosion and sedimentation control program will be implemented to minimize temporary impacts to wetland resource areas during the construction phase of the project. The program incorporates Best Management Practices (BMPs) specified in guidelines developed by the DEP 9 and the U.S. Environmental Protection Agency (EPA)10. Proper implementation of the erosion and sedimentation control program will: › minimize exposed soil areas through sequencing and temporary stabilization; › place structures to manage stormwater runoff and erosion; and › establish a permanent vegetative cover or other forms of stabilization as soon as practicable. The following sections describe the controls that will be used and practices that will be followed during construction. These practices comply with criteria contained in the NPDES General Permit for Discharges from Large and Small Construction Activities issued by the EPA. Non-structural Practices Non-structural practices to be used during construction include, temporary seeding, permanent seeding, and pavement sweeping. These practices will be initiated as soon as practicable in appropriate areas at the site. Temporary and Permanent Seeding If conditions allow, a temporary vegetative cover will be established on areas of exposed soils during construction. Upon completion of final grading, any areas not covered by pavement, other forms of stabilization, or other methods of landscaping will be seeded with a native seed mix (per MassDOT Specification #765.635). The mix will be applied at the rate suggested by its manufacturer. Pavement Sweeping The shared use path (once paved) and the portions of the adjacent street and driveways along the Project Limits shall be swept as needed during construction. The sweeping program will remove sediment and other contaminants directly from paved surfaces before their release into stormwater runoff. A street sweeper shall be kept at the site or at a nearby location to facilitate this practice. 9 DEP, 1997. Notice of Intent A-7 Attachment A: Notice of Intent Narrative Structural Practices Structural erosion and sedimentation controls to be used on the site include barriers and catch basin inlet protection. Erosion Control Barriers Prior to any ground disturbance, an approved erosion control barrier (per MassDOT Specification #767.121) will be installed at the downgradient limit of work. As construction progresses, additional barriers will be installed around the base of stockpiles and other erosion-prone areas. If sediment has accumulated to a depth that impairs proper functioning of the barrier, it will be removed by hand or by machinery operating upslope of the barriers. This material will be either reused at the Site or disposed of at a suitable offsite location. Any damaged sections of the barrier will be repaired or replaced immediately upon discovery. Catch Basin Inlet Protection The inlets of existing and proposed catch basins will be protected from sediment inflow during the work period by surrounding them with a barrier of staked straw bales or by installing other barrier methods determined by the contractor. Stormwater Management Runoff generated from impervious surfaces will be collected and managed in accordance with the DEP policy. This project is a shared use path for pedestrians and bicyclists. Per 310 CMR 10.05(6)(m)6, footpaths, bike paths, and other paths for pedestrian and/or nonmotorized vehicle access are required to comply the Stormwater Management Standards only to the maximum extent possible. The project complies with Standards 1 and 3-10 and complies with Standard 2 to the maximum extent practicable. A stormwater management system will be constructed that includes measures to provide groundwater recharge, attenuate peak flows and provide water quality treatment. compliance with the 10 stormwater management standards is included in the accompanying Stormwater Management Memorandum (See Attachment D). Regulatory Compliance As described above, the Project will require work within the 50-foot buffer zone established by the Ordinance and therefore the Applicant is seeking a waiver from this Performance Standard. The Project will not require work in any areas subject to WPA jurisdiction because ISLF does not support a 100-foot buffer zone. As described in the Mitigation Measures section of this narrative, the Project includes provisions to minimize short and long-term impacts to adjacent wetlands. Work in Locally Established Areas As discussed above, the Ordinance requires that a 50-foot undisturbed buffer zone shall be retained between the landward-most wetland resource areas and the limit of proposed site disturbance. However, the Conservation Commission shall have the discretion to grant a waiver should it find that Notice of Intent A-8 Attachment A: Notice of Intent Narrative the overall project, when considered with its proposed mitigation, will protect the wetland interests contained in the Ordinance. The Project will result in a disturbance in the 50-foot buffer of approximately 2,510 square feet. As described above, the Applicant is proposing mitigation measures to minimize the risk of secondary impacts to resource areas by installing structural erosion and sedimentation controls. The alignment of the shared use path has been designed to minimize tree clearing activities by utilizing an area of the 50-foot buffer zone that has been primarily previously cleared. Due to safety considerations, the path cannot be located closer to the road at the driveway without resulting in increased conflicts with incoming traffic. As a result, the Project will require unavoidable work within 50 feet of Wetland 1. Therefore, the Applicant is requesting that the Commission grant the Project a waiver of the Performance Standards found in Section 704-3 of the Ordinance. The Ordinance establishes at 704-6.A.(1) that This Regulation shall not be construed to preclude the following activities, any of which may be permitted at the Commission’s discretion, and without accompanying requirement for mitigation planting: (1) Access paths; Therefore, the Project is exempt from the mitigation requirements established by the Ordinance and no formal mitigation is proposed. However, landscape plantings are proposed along the Bearses Way corridor as part of the Project. Details of the proposed plantings, including species, planting schedule and layout are shown on the accompanying Project Plans. Summary The Town of Barnstable, is proposing to construct a shared-use path on the west side of Bearses Way, beginning 450 feet north of Falmouth Road and ending at Pitcher’s Way in Barnstable, MA. Work associated with the Project consists of constructing a new 0.72-mile paved bicycle and pedestrian shared-use path along the west side of Bearses Way. Work will be required within the 50-foot buffer zone established by the Ordinance. No work is proposed within areas subject to the jurisdiction of the WPA. Because portions of the work are located within the 50-foot buffer zone, the Applicant is requesting that the Commission grant the Project a waiver of the Performance Standards found in Section 704-3 of the Ordinance. Mitigation plantings for impacts to the 50-foot buffer zone are not proposed because the construction of access paths is considered exempt from the mitigation requirements of the Ordinance. No permanent impacts to wetland resource areas are proposed. Erosion and sedimentation controls will be employed throughout construction to prevent any secondary impacts to resource areas. Project Description The applicant, Town of Barnstable Department of Public Works (DPW), is proposing a shared use path along Bearse’s Way in the village of Hyannis from the Town DPW yard drive approximately 500 feet north of the intersection with Route 28 to Pitcher’s Way. The majority of the 0.72-mile project is proposed to be constructed within lands controlled by the Town of Barnstable. A small portion of the path is proposed within the existing layout of Bearse’s Way. To provide separation from the roadway, the path alignment is outside the public way into a large Town owned parcel and one privately owned parcel. The proposed cross section of the path will consist of a 10-foot-wide paved travel surface, 3-foot shoulders, and linear stormwater best management practices (BMPs) throughout the alignment. The path will contain an at-grade accessible intersection at one cross street – Pitcher’s Way. The Town of Barnstable is in the process of evaluating a crossing of Bearse’s Way at the Enterprise Road intersection to link the shared use path with an existing sidewalk on the south side of Enterprise Road. The Project has been designed to comply the Stormwater Management Standards to the maximum extent practicable, and to improve upon existing conditions. Site Description General Site The linear Project Area is primarily located outside of the Conservation Commission’s jurisdiction as there are limited regulated areas in the general vicinity of the project. However, there are two flagged wetland areas located at the south end of the project. Approximately 400’ linear feet of the proposed shared use path are located within the 100-ft buffer zone to BVW. This area is jurisdictional and extends from the Water Pollution Control Division’s driveway #1 \\vhb\gbl\proj\Wat-TE\12338.00\docs\memos\Bearses Stormwater Memo for NOI_SaveAs.docx (Station to 1+75) to Water Pollution Control Division’s driveway #2 (Station 5 + 50). There is 3,220 square feet of new impervious area within the 100-ft buffer zone. Watershed The Project Area is located within the larger Cape Cod Watershed, specifically the watershed that drains to Hyannis Harbor, which currently does not have any stormwater related Total Maximum Daily Loads (TMDLs), however it does have a Pathogen TMDL. Land Use Land uses adjacent to the Project Area are primarily transportation, industrial, forest, and commercial. The path would follow alongside Bearse’s Way starting at the intersection with the Department of Public Works truck driveway (Station 0+ 50) and ending at the intersection of Pitcher’s Way (Station 38+00). There are no known land uses with higher potential pollutant loads (LUHPPLs) in or with drainage areas directly tributary to the Project Area. Environmental Areas There are two flagged wetland areas located at the south end of the project. Additionally, the majority of the project area is located within a Zone II Wellhead Protection Area. As indicated in Figure 2, the two flagged wetland areas and their associated buffer zones are located outside of the Zone II Wellhead Protection Area. Please see Figure 2 for the graphical representation of the wetland buffer zone, the Zone II Wellhead Protection Area, and the project area boundary. Land Cover Land cover within the existing Project Area consists predominately of grass. The project proposes a 0.72-mile long, 10-foot-wide paved share use path in the existing grass area. Topography As the topography of the Project Area follows the existing roadway profile, several local low and high points are located within the Project Area. The Project Area is fairly flat, with slopes along the corridor ranging from 0.60% to 3.9%. Soils The Natural Resources Conservation Service (NRCS) soil survey indicates that approximately 97% of the soil within the project area is loamy sand and the other 3% as urban land (see NRCS Soil Map Figure). The soils in the project are rated Hydraulic Soil Group (HSG) A, meaning they have high infiltration rates when wet and high rate of water transmission. Proposed Drainage Conditions The project results in 3,220 square feet of new impervious area within the wetland 100-ft buffer zone. The project is designed to have the stormwater sheet flow off the shared used path to a grass swale on the east side of the pathway. As the soils underlying the swale have a high infiltration rate, runoff will infiltrate along the length of the swale. In larger events, runoff will flow downstream to a local low point equipped with a stone pad, where it will infiltrate. The proposed path will not result in a direct drainage discharge to the wetland and no new outlets will be created. Along the remainder of the project, outside Wetlands Protection Act (WPA) jurisdiction, the same concept will apply, with runoff sheet flowing to swales where it will infiltrate. Massachusetts Department of Environmental Protection (MassDEP) – Stormwater Management Standards This project is a shared use path for pedestrians and bicyclists. Per 310 CMR 10.05(6)(m)6, footpaths, bike paths, and other paths for pedestrian and/or nonmotorized vehicle access are required to comply the Stormwater Management Standards only to the maximum extent possible. The project complies with Standards 1 and 3-10 and complies with Standard 2 to the maximum extent practicable. Standard 1: No New Untreated Discharges or Erosion to Wetlands The Project has been designed to comply with Standard 1. The Project does not propose any new outfalls discharging directly to wetlands. Standard 2: Peak Rate Attenuation The Project has been designed to comply with Standard 2 to the maximum extent practicable. The project does result in increases to peak rates leaving the project area. HydroCAD was used to model the watershed within the conservation commission’s jurisdiction, the results of the peak rates can be seen in the \\vhb\gbl\proj\Wat-TE\12338.00\docs\memos\Bearses Stormwater Memo for NOI_SaveAs.docx project below. The peak rates increase by 0.09, 0.25, and 0.52 cfs for the 2-, 10-, and 100-year events respectively. The peak rate increases are primarily due to approximately 770 square feet of pathway sloping towards the Water Pollution Control Division’s driveway #1 (Station 1+ 75) to ensure a safe crossing for those on bikes. For this project, the required recharge volume was calculated to be 165 cubic feet, as demonstrated below. 3220 ∗ ." " 161 As indicated in the HydroCAD printout included as Appendix 3, the proposed design infiltrates the entire 2-yr storm event (3.23 inches of rainfall), which exceeds to the 0.6-inch required recharge depth. As a result, the project complies with Standard 3. Standard 4: Water Quality The Project has been designed to comply with Standard 4. The Stormwater Management Standards require that the proposed stormwater management system be designed to remove 80% of the annual post-construction load of Total Suspended Solids (TSS). This is met when the BMPs are sized to treat the water quality volume. As the project is located in an area with a rapid infiltration rates, the 1-inch treatment depth is used to determine the required water quality volume. The project is not considered a land use with higher potential loads (LUHPPLs). Standard 6: Critical Areas The Project has been designed to comply with Standard 6. While a portion of the project is located within a Zone II Wellhead Protection Area, all stormwater discharges within WPA jurisdiction are located outside of critical areas. As a result, the pretreatment requirements associated with discharges to critical areas do not apply. Standard 7: Redevelopments and Other Projects Subject to the Standards only to the Maximum Extent Practicable This project is a shared use path for pedestrians and bicyclists. As noted in the Checklist, the Stormwater Management Report shall document compliance with each of the Stormwater Management Standards as provided in the Massachusetts Stormwater Handbook. The soils evaluation and calculations shall be done using the methodologies set forth in Volume 3 of the Massachusetts Stormwater Handbook. To ensure that the Stormwater Report is complete, applicants are required to fill in the Stormwater Report Checklist by checking the box to indicate that the specified information has been included in the Stormwater Report. If any of the information specified in the checklist has not been submitted, the applicant must provide an explanation. Standard 4: Water Quality The Long-Term Pollution Prevention Plan typically includes the following:  Good housekeeping practices;  Provisions for storing materials and waste products inside or under cover;  Vehicle washing controls;  Requirements for routine inspections and maintenance of stormwater BMPs;  Spill prevention and response plans;  Provisions for maintenance of lawns, gardens, and other landscaped areas;  Requirements for storage and use of fertilizers, herbicides, and pesticides;  Pet waste management provisions;  Provisions for operation and management of septic systems;  Provisions for solid waste management;  Snow disposal and plowing plans relative to Wetland Resource Areas;  Winter Road Salt and/or Sand Use and Storage restrictions;  Street sweeping schedules;  Provisions for prevention of illicit discharges to the stormwater management system;  Documentation that Stormwater BMPs are designed to provide for shutdown and containment in the event of a spill or discharges to or near critical areas or from LUHPPL;  Training for staff or personnel involved with implementing Long-Term Pollution Prevention Plan;  List of Emergency contacts for implementing Long-Term Pollution Prevention Plan. A Long-Term Pollution Prevention Plan is attached to Stormwater Report and is included as an attachment to the Wetlands Notice of Intent. LUHPPLs are located at the site and industry specific source control and pollution prevention measures have been proposed to reduce or eliminate the exposure of LUHPPLs to rain, snow, snow melt and runoff, and been included in the long term Pollution Prevention Plan. This document has been prepared in accordance with the requirements of the Stormwater Regulations included in the Massachusetts Wetlands Protection Act Regulations (310 CMR 10). Responsible Party The Town of Barnstable DPW will be responsible for the maintenance of the shared used path facilities and associated stormwater management features, in accordance with Town standards. Questions or concerns regarding maintenance activities may also be addressed to Town of Barnstable DPW: Town of Barnstable DPW 382 Falmouth Road Hyannis MA 02601 Phone: (508) 790-6400 Maintenance Measures The stormwater management system covered by this Operation and Maintenance Plan consists of the following components: • Drainage Swales • Stone Pads to promote Infiltration • Maintenance of these components will be conducted in accordance with Town of Barnstable DPW standard maintenance practices, as noted in the attached Operation and Maintenance table summarizing the pertinent inspection and maintenance activities. Page | 2 If inspection indicates the need for major repairs of structural surfaces, the inspector should contact the Town of Barnstable DPW to initiate procedures to effect repairs in accordance with Town of Barnstable DPW standard construction practices. Practices for Long Term Pollution Prevention In general, long term pollution prevention and related maintenance activities will be conducted consistent with Town of Barnstable DPW’s NPDES Stormwater MS4 Permit. For the facilities covered by this Operation and Maintenance Plan, long term pollution prevention includes the following measures: Routine Inspection and Maintenance of Stormwater BMPs The Town of Barnstable DPW will conduct inspection and maintenance of the stormwater management practices in accordance with the information in Table 1. Spill Prevention and Response The Town of Barnstable is currently developing a Spill Prevention, Control, and Countermeasure (SPCC) Policy Guide, which will implement response procedures for releases of significant materials such as fuels, oils, or chemical materials onto the ground or other areas that could reasonably be expected to discharge to surface or groundwater. •Reportable quantities will immediately be reported to the applicable Federal, State, and local agencies as required by law. •Applicable containment and cleanup procedures will be performed immediately. Impacted material collected during the response must be removed promptly and disposed of in accordance with Federal, State, and local requirements. A licensed emergency response contractor may be required to assist in cleanup of releases depending on the amount of the release and the ability of the responsible party to perform the required response. •Reportable quantities of chemical, fuels, or oils are established under the Clean Water Act and enforced through DEP. Snow and Ice Management Roadways are pretreated with deicing liquid before storms with modified spreaders. This has eliminated the need for the use of sand treatments for snow and ice, greatly reducing the amount of sand/sediment accumulation in inlet structures. Prohibition of Illicit Discharges The DEP Stormwater Management Standards prohibit illicit discharges to the storm water management system. Illicit discharges are discharges that do not entirely consist of stormwater, except for certain specified non-stormwater discharges. Page | 3 Discharges from the following activities are not considered illicit discharges: firefighting foundation drains water line flushing footing drains landscape irrigation individual resident car washing uncontaminated groundwater flows from riparian habitats and wetlands potable water sources dechlorinated water from swimming pools water used to clean residential buildings without detergents water used for street washing air conditioning condensation There are no known or proposed illicit connections associated with this project. If a potential illicit discharge to the facilities covered by this plan is detected (e.g., dry weather flows at any pipe outlet, evidence of contamination of surface water dis charge by non-stormwater sources), the Town of Barnstable DPW shall be notified for assistance in determining the nature and source of the discharge, and for resolution through the DPW’s IDDE program.
