Ltr request to continue from 10 12 22 to 11 9 22Nutter October 7, 2022 #124005-1 Via Email and First Class Mail Jacob Dewey, Chair Barnstable Zoning Board of Appeals 367 Main Street Hyannis, MA 02601 Re: 157 Thornton, LLC Appeal No. 2022-039 and 2022-040 Dear Chairman Dewey: Eliza Cox Direct Line: 508-790-5431 Fax: 617-310-9191 E-mail: ecox@nutter.com On behalf of 157 Thornton, LLC, the Applicant in the above-referenced appeals, I am requesting that both petitions currently scheduled for the October 12th Zoning Board of Appeals (the "Board") agenda be continued without testimony to the November 9, 2022 hearing agenda. We acknowledge that this is our 2nd continuance request, and we appreciate the Board's patience as my client and its consultant team incorporate modifications to the proposed expansion based on communications with the Barnstable Fire Department. Unfortunately, though, we just need a little more time to work through some of the details and to update the plans. I have reviewed the timeframes with my client and we are confident that we will have everything ready for the November 9th hearing, including submitting revised materials in advance to the Board. However, in the unlikely event that we are not able to proceed at the next hearing, we will seek to withdraw the applications. Further, as needed, we will agree to extend any procedural timeframes to allow for this continuance. Thank you for your assistance with this matter. With best regards, I am, Very truly yours, Eliza Cox EZC:cam cc: 157 Thornton, LLC 5735030.1 Nutter McClennen & Fish LLP / 1471 lyannough Rd, P.O.
