DMF Eversource_Barnstable_11-29140_MidCape_NOI September 27, 2022 Matthew Devlin Eversource Energy 247 Station Drive, SE 2122 Westwood MA 02090 RE: Applicant: Eversource Energy Project Location: Right-of-Way & Substation at 625 & 661 Oak Street, Barnstable Project Description: MidCape Reliability Project: Construct new transmission line, relocate distribution line and electric substation upgrades DEP Wetlands File No.: 003-6032 NHESP Tracking No.: 11-29140 Dear Commissioners: The applicant listed above has submitted a Notice of Intent with site plans (dated 9/6/2022) to the Natural Heritage & Endangered Species Program of the Massachusetts Division of Fisheries & Wildlife (the “Division”), in compliance with the rare wildlife species section of the Massachusetts Wetlands Protection Act Regulations (310 CMR 10.59). The Division recently reviewed this project pursuant to the Massachusetts Endangered Species Act (MESA) (MGL c.131A) and its implementing regulations (321 CMR 10.00) and issued a determination letter (dated 9/23/2022, Attached). Based on a review of the information that was provided and the information that is currently contained in our database, the Division has determined that this project, as currently proposed, will not adversely affect the actual Resource Area Habitat of state-protected rare wildlife species. Therefore, it is our opinion that this project appears to meet the state-listed species performance standard for the issuance of an Order of Conditions. Please note that this determination addresses only the matter of rare wildlife habitat and does not pertain to other wildlife habitat issues that may be pertinent to the proposed project.
