March 2022 Page 1 CHAPTER 707 Regulation Governing Minimum Submission Requirements for a Notice of Intent Application The Barnstable Conservation Commission has adopted the following requirements in order to obtain more consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent (NOI) applications. Failure to complete any of the items in this checklist may result in your application being denied. Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain instances, like field staking, denoting that the task will be completed. The following submission checklist covers the requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOI application. 1.Requirements a.The applicant understands, unless they’ve instructed otherwise, they are applying both under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and Chapter 237 of the Town of Barnstable General Ordinances. b.Attach a written narrative to the NOI application (WPA Form 3), available at: www.mass.gov/eea/agencies/massdep/service/approvals/wpa-form-3.html describing any project impacts and proposed mitigation as they relate to the following: 1)Any of the interests of Chapter 237 of the General Ordinances and the MassDEP Wetlands Protection Act M.G.L. 131, §40. 2)The performance standards contained in the MassDEP Wetlands Protection Regulations (310 CMR 10.00) 3)Chapter 704: Regulation Governing Activity in the 100-ft. Make sure that the flags are sequentially numbered. c.Provide a project identification stake with bright painted top and applicant name and address, easily visible from the street approaching the site. 4.Legal Advertisement Fees: a.Conservation will submit the legal ad for publication in a local newspaper. The applicant or his/her agent is responsible for payment, by check (payable to the Town of Barnstable), at the hearing or by mail. The cost of the legal ad will be pre-calculated and posted on the hearing agenda prior to the hearing. 5.Minimum Documentation for a Complete Application: a.Provide a completely filled-out (in all parts) NOI application as locally adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form. Indicate Assessor’s map and parcel of the project, as well as the street or road address, and pertinent village (i.e., Hyannis, Centerville, Barnstable, etc). b.Provide two (2) original project plans, stamped in blue or red ink (wet stamp). Plans must be signed and dated by a Massachusetts licensed, professional engineer, land surveyor, architect or landscape architect (as applicable), and shall be drawn at a readable scale (1" = 20' preferred). The planting plan shall include species list (chosen from the Town of Barnstable Conservation Commission approved planting lists), sizes, densities and/or quantities. The plan shall also provide area calculations between 0 to 50 and 50 to 100 separately for the amount of mitigation planting required, and the amount of mitigation planting proposed. e.Provide detailed, written street directions to the locus (site). f.Provide a copy of a U.S.G.S. locus map indicating the general area of the project site. g.Provide a check for the Town of Barnstable portion of the required filing fee. (The portion payable to the Commonwealth, see 7. e. below) h.Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in the field which may be relevant to the application. 6.The site plan shall also show: a.All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred). b.Clear delineation of all existing and proposed structures and features. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource a reas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On complicated sites, existing and proposed conditions must be shown on separate sheets. c.Locus inset map of the site clearly showing its location relative to surrounding public streets. d.All wetland resource area flags by individual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area. The individual who performed the flagging and date of flagging shall be identified on the plan next to the resource line. e. Section views showing changes in grade, cuts and fills. 7.SUBMISSION OF THE COMPLETED APPLICATION WITH PLANS: a.Provide a signed Permission to Access Property, Form PA. Existing Property Description The locus of the subject property is on the north side of Nantucket Sound in Osterville, Massachusetts. The property has a gross area of approximately 1.8 acres (established to mean high water) and features approximately 135 linear feet of waterfront on Nantucket Sound. The property is located in a developed residential use area and is currently developed with various structures, including a two- story, single-family residence, garage, tennis court, hardscape, gravel drive and associated site amenities, including subsurface sewage disposal system. The site includes an expansive dune field and beach. II. FEMA Flood Zones A small portion of the subject property lies within Land Subject to Coastal Storm Flowage. Specifically, within one (1) FEMA mapped Zones VE (El. 15-feet 1), special flood hazard areas subject to inundation by the 1% annual chance flood (100-year flood event). These flood designations are shown on FEMA Flood Insurance Rate Map (FIRM) Number 25001C0757J, effective date July 16, 2014. Project Description The applicant proposes to remove: the existing two-story dwelling; the garage; all existing hardscape; the existing septic system; the existing concrete tennis court; and the gravel drive. The applicant proposes to: Construct a new two-story, four bedroom, single-family dwelling with attached garage and associated hardscape outside 0-50’ buffer; Construct a new carriage house and associated parking court and hardscape outside 100’ buffer; Construct a tennis court, tennis cabana and associated hardscape outside the 100’ buffer; Construct a new gravel drive outside the 100’ buffer; Install new sewage disposal system which will be located entirely outside of the 100’ buffer. A portion of the existing structure resides within the 0’-50’ buffer. The new dwelling and attached garage will be constructed entirely outside of the 50’ buffer. A portion of the existing lawn area within the 0’-50’ buffer is proposed to be regraded and replaced in kind with new lawn. No native vegetation or trees are to be removed within the buffer zone. The existing sewage disposal system will be removed and will be relocated, reconfigured, and upgraded to a fully Title 5 compliant sewage disposal system, located entirely outside the 100’ buffer zone on site. All new utilities will be installed to the new buildings. Roof runoff for the new buildings will be managed through the installation of gutters and downspouts routed to drywells. No mitigation has been proposed as there is no increase in coverage within both the 0’-50’ buffer and the 50’-100’ buffer zones. C19910.01: Notice of Intent 771 SVA LLC , 771 Sea View Avenue, Osterville Page 3 of 8 Performance Standards Narrative The proposed project meets the performance standards of the Massachusetts State Wetlands Protection Act (WPA) Performance Standards as set forth in the Regulations at 310 C.M.R. 10.00, et seq., as well as those adopted by the Barnstable Conservation Commission and set forth in the local Barnstable Wetlands Regulations. The following sections address how these performance standards are met for the proposed project and provide evidence demonstrating that the proposed project will not have significant adverse impacts to the resource areas, as those areas are defined within the State and Local regulations. I. Wetland Performance Standards - (310 CMR 10.00) State WPA Regulations 10.28: Coastal Dunes Performance Standards (3) Any alteration of, or structure on, a coastal dune or within 100 feet of a coastal dune shall not have an adverse effect on the coastal dune by: (a) affecting the ability of waves to remove sand from the dune; • No work within the resource area (b) disturbing the vegetative cover so as to destabilize the dune; • No work within the resource area (b) causing any modification of the dune form that would increase the potential for storm or flood damage; • No work within the resource area (c) interfering with the landward or lateral movement of the dune; • No structures are to be constructed that would impede the lateral movement of the dune landward. (d) causing removal of sand from the dune artificially; or • No work within the resource area (e) interfering with mapped or otherwise identified bird nesting habitat. • N/A (4) Notwithstanding the provisions of 310 CMR 10.28(3), when a building already exists upon a coastal dune, a project accessory to the existing building may be permitted, provided that such work, using the best commercially available measures, minimizes the adverse effect on the coastal dune caused by the impacts listed in 310 CMR 10.28(3)(b) through (e). Such an accessory project may include, but is not limited to, a small shed or a small parking area for residences. It shall not include coastal engineering structures. (b) fencing and other devices designed to increase dune development; and • N/A (c) plantings compatible with the natural vegetative cover. • N/A (6) Notwithstanding the provisions of 310 CMR 10.28(3) through (5), no project may be permitted which will have any adverse effect on specified habitat sites of Rare Species, as identified by procedures established under 310 CMR 10.37. • N/A. The project site is outside any NHESP mapped area. 10.30: Coastal Banks Performance Standards (3) No new bulkhead, revetment, seawall, groin or other coastal engineering structure shall be permitted on such a coastal bank except that such a coastal engineering structure shall be permitted when required to prevent storm damage to buildings constructed prior to the effective date of 310 CMR 10.21 through 10.37 or constructed pursuant to a Notice of Intent filed prior to the effective date of 310 CMR 10.21 through 10.37 (August 10, 1978), including reconstructions of such buildings subsequent to the effective date of 310 CMR 10.21 through 10.37, provided that the following requirements are met: (a) a coastal engineering structure or a modification thereto shall be designed and constructed so as to minimize, using best available measures, adverse effects on adjacent or nearby coastal beaches due to changes in wave action, and (b) the applicant demonstrates that no method of protecting the building other than the proposed coastal engineering structure is feasible. (c) protective planting designed to reduce erosion may be permitted. • N/A. No coastal engineering structures are proposed as part of the proposed project. C19910.01: Notice of Intent 771 SVA LLC , 771 Sea View Avenue, Osterville Page 5 of 8 (4) Any project on a coastal bank or within 100 feet landward of the top of a coastal bank, other than a structure permitted by 310 CMR 10.30(3), shall not have an adverse effect due to wave action on the movement of sediment from the coastal bank to coastal beaches or land subject to tidal action. • The coastal bank on this property is fronted by a coastal dune and coastal beach. No work is proposed other than regrading of the lawn and removal of the existing deck within the 0’-50’ buffer. (5) The Order of Conditions and the Certificate of Compliance for any new building within 100 feet landward of the top of a coastal bank permitted by the issuing authority under M.G.L. c. 131, § 40 shall contain the specific condition: 310 CMR 10.30(3), promulgated under M.G.L. c. 131, § 40, requires that no coastal engineering structure, such as a bulkhead, revetment, or seawall shall be permitted on an eroding bank at any time in the future to protect the project allowed by this Order of Conditions. (6) Any project on such a coastal bank or within 100 feet landward of the top of such coastal bank shall have no adverse effects on the stability of the coastal bank. • The activities taking place within 100 feet of it will be the removal the existing structure, the construction of the new dwelling and associated hard scape further from the resource areas as well as minor regrading. None of these activities should adversely affect the stability of the bank. (7) Bulkheads, revetments, seawalls, groins or other coastal engineering structures may be permitted on such a coastal bank except when such bank is significant to storm damage prevention or flood control because it supplies sediment to coastal beaches, coastal dunes, and barrier beaches. • N/A. No coastal engineering structures are proposed as part of the proposed project. (8) Notwithstanding the provisions of 310 CMR 10.30(3) through (7), no project may be permitted which will have any adverse effect on specified habitat sites of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.37. • N/A. The project site is outside any NHESP mapped area. Land Subject to Coastal Storm Flowage The MA DEP Wetland Regulations set forth in 310 CMR 10.00 contain no performance standards for work within LSCSF. II. Barnstable Wetlands Protection Regulations Land Subject To Coastal Storm Flowage - No work is taking place within the VE Zone or any other flood zone with moderate wave action, so the Barnstable guidance pertaining to LSCSF is not applicable. Chapter 705 – Coastal Banks - The Coastal Bank on site does meet the local Town of Barnstable definition. (see notes in previous section) C19910.01: Notice of Intent 771 SVA LLC , 771 Sea View Avenue, Osterville Page 6 of 8 Chapter 704 – Wetlands Buffer Zone Activity – Pursuant to Section 704-3: (C) Where a fifty-foot undisturbed buffer zone, as measured in accordance with the definition of "fifty-foot undisturbed buffer zone" in § 704-2, does not exist prior to the proposed work, any work proposed within the one-hundred-foot. buffer zone shall be subject to mitigation planting requirements intended to restore, in so far as possible, both the dimensions of a fifty-foot undisturbed buffer and its vegetation. For such work proposed within the fifty-to-one-hundred-foot zone, the calculation of mitigation is set forth in Subsection D. (D) Calculation of mitigation for work proposed within the fifty-to-one-hundred-foot buffer. The amount of mitigation planting required for work proposed within the fifty-to-one-hundred-foot buffer zone shall be determined by the following method: (1) Calculate area of proposed hardscape within the fifty-to-one-hundred-foot buffer zone; (2) Multiply the area found in Subsection D(1) by three to obtain the area of required mitigation at a planting to disturbance ratio of 3:1. (3) In no case shall the total area of mitigation plantings required be greater than that which is necessary to restore a fifty-foot undisturbed buffer in its entirety. A "fifty-foot undisturbed buffer zone" in § 704-2, does not exist on this property. However, the proposed project will not result in any increase in coverage within these zones. III. Summary The project meets the performance standards set forth in both the Massachusetts Wetland Protection Regulations and the Barnstable Wetland Protection Ordinance. As set forth in the foregoing Narrative, the proposed project will result in no significant or cumulative negative effects upon the wetland values defined within the Town of Barnstable Wetlands Protection Ordinance and no adverse impacts to the wetland interests defined in the Massachusetts Wetland Protection Regulations. II. On-Site Pre-Construction Conference Prior to the start of any sitework or construction, a pre-construction meeting will be held on site to discuss the project requirements with the following parties represented: • General Contractor • Sitework Contractor • Coastal Engineering Co., Inc. Any deficiencies shall be addressed prior to the commencement of work. III. Limit of Work The Sitework Contractor shall familiarize himself with the boundaries of the property and the limit of work. The Contractor shall exercise care in order to protect adjacent properties and wetland resource areas. The Contractor shall not operate heavy equipment outside the work limit as shown on the approved plan and delineated by the erosion and sedimentation control barrier. The contractor shall practice good housekeeping measures during the day-to-day operations at the site. The site should be policed daily to remove any litter or construction debris. Care shall be taken that no debris be allowed outside the work limit. Debris outside the work limit shall be picked up immediately.
