An Approval Not Required plan entitled “Plan of Land of 107 & 119 Shell Lane Cotuit, MA” prepared for Michael Manning, drawn and stamped by Daniel Ojala, P.L.S. of Down Cape Engineering last revised May 18, 2022, has been submitted to the Board for endorsement as an Approval Not Required (ANR) plan. The plan proposes an equal swap of land. No new buildable lots are to be created by this plan. Background & Proposal The subject properties are located within the Residence F District (RF) which requires 20 feet of frontage. The subject properties are also within the Resource Protection Overlay District. The minimum lot area requirement in all residential zoning districts within the Resource Protection Overlay District shall be 87,120 square feet.  Lots 3 – Contains 150 linear feet of frontage and 48,477 square feet of upland and is identified as a preexisting nonconforming lot.  Lots 4 – Contains 130 linear feet of frontage and 21,872 square feet of upland and is identified as a preexisting nonconforming lot.  Parcel A – Contains 631 square feet of land area and no frontage.  Parcel B - Contains 631 square feet of land area and 15 feet of linear frontage. Parcel A is to be combined with Lot 3. Parcel B is to be combined with Lot 4. Due to the fact that Lot 3 and 4 are preexisting nonconforming parcels, the equal swap of land has required a variance for each Lot 3 and 4 which was granted on December 14, 2021 by the Zoning Board of Appeals. Findings The plan as submitted qualifies as an ANR Plan and it should be endorsed by the Board as:  It does not constitute a subdivision because either the lot is labeled “not a building lot” or each of the lots have the minimum required frontage and the way was in existence when the Subdivision Control Law took effect in the municipality having suitable grades, and adequate construction to 2 provide for the needs of vehicular traffic in relation to the proposed use and for the installation of municipal services to serve such use; and  All materials and conditions of Chapter 801, Article IV Approval Not Required Plans, have been submitted and are in full compliance. If the Board agrees, a motion should be formulated to: Endorse the plan entitled “Plan of Land of 107 & 119 Shell Lane Cotuit, MA” prepared for Michael Manning, drawn and stamped by Daniel Ojala, P.L.S. of Down Cape Engineering last revised May 18, 2022 as an Approval Not Required Plan.
